URGENT APPEAL – THE OBSERVATORY, SYRIA

The Observatory for the Protection of Human Rights Defenders, a joint programme of the International Federation for Human Rights (FIDH) and the World Organisation Against Torture (OMCT), requests your urgent intervention in the following situation in Syria.
Description of the situation:
The Observatory has been informed by reliable sources about the arbitrary arrest of Mr. Abdul Hafiez Abdul Rahman and Ms. Nadira Abdu, members of the Board of Trustees of the Human Rights Organisation in Syria (MAF), an organisation which defends the rights of the Kurdish minority in Syria.
According to the information received, on March 2, 2010, Mr. Abdul Rahman was arrested in his house in the Ashrafieh district, Aleppo, along with co-worker Ms. Nadira Abdu who was with him at the time. Ms. Nadira Abdu was later released on March 6, 2010 whereas Mr. Abdul Rahman remains detained as to date. They were detained at the military security branch in Aleppo city north. However, since March 7, 2010, the whereabouts of Mr. Abdul Rahman are unknown. No charges have been officially brought against the two human rights defenders.
During the raid, the security patrol asked Ms. Nadira Abdu why she came to Mr. Abdul Rahman’s house three times a day. They also asked the two defenders about different cases they were working on and, more generally, about their work within the Human Rights Organisation in Syria. They confiscated some reports issued by MAF as well as Mr. Abdul Hafiez’s computer and several books written in Kurdish. The patrol failed to display any legal warrant to justify this procedure.
The Observatory denounces the arbitrary arrest of Mr. Abdul Rahman and Ms. Nadira Abdu which seem to merely aim at sanctioning their human rights activities, as well as the ongoing enforced disappearance of Mr. Abdul Rahman.
The Observatory further fears for Mr. Abdul Rahman’s physical and psychological integrity and calls upon the Syrian authorities to take prompt action in order to disclose his whereabouts and to immediately and unconditionally release him, as well as all human rights defenders presently detained in the country. These events illustrate once more the situation of extreme insecurity faced by human rights defenders in Syria
Actions requested:
Please write to the Syrian authorities authorities, urging them to:
i. Guarantee in all circumstances the physical and psychological integrity of Mr. Abdul Rahman and Ms. Nadira Abdu;
ii. Take prompt action in order to disclose the whereabouts of Mr. Abdul Rahman and ensure his immediate and unconditionally release since his detention is arbitrary as it only aims at sanctioning his human rights activities;
iii. Order a thorough and impartial investigation into the above-mentioned facts in order to identify all those responsible, bring them before a civil competent and impartial tribunal and apply to them the penal sanctions provided by the law;
iv. Put an end to any acts of harassment, including at the judicial level, against Mr. Abdul Rahman and Ms. Nadira Abdu and more generally against all human rights defenders in Syria;
v. Conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, especially its Article 1, which states that “everyone has the right, individually and in association with others, to promote and to strive for the protection and realization of human rights and fundamental freedoms at the national and international levels”, and Article 12.2, which provides that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”;
vi. Ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by the Syrian Arab Republic.
